Q&A with Seth Bader, Founder and CEO of Bader Law Personal Injury Lawyers

After a workplace injury, many people rely on what a coworker told them or what they assume the rules are. Those assumptions can lead to missed deadlines, lost benefits, or a claim that never gets filed. Seth Bader addresses some of the myths he hears most often.
Q: What is the biggest misconception you hear from clients?
That a minor injury isn’t worth reporting. Back strains and repetitive-motion injuries can worsen over weeks. In Georgia, workers generally must notify their employer within 30 days, and waiting can put a claim at risk. Report it in writing and note the date and who you told.
Q: What if the accident was partly the worker’s fault?
Georgia workers’ compensation is generally a no-fault system, so benefits usually don’t depend on who caused the accident. A worker who slipped or made a mistake can typically still qualify. There are exceptions, such as injuries caused by intoxication or willful misconduct.
Q: What if I had a back or knee problem before? Many workers assume a pre-existing condition disqualifies them. In Georgia, a work injury that aggravates an existing condition may still be covered. Be honest with doctors about your history, and ask them to document how the work injury changed your symptoms.
Q: Do I have to see the doctor my employer chooses?
Employers typically must post a panel of physicians, and injured workers can usually choose from that list. Knowing your options matters, because the treating doctor’s opinion can affect how long benefits last and what treatment gets approved.
Q: Do I need a lawyer if my employer is cooperating?
Not always. But if benefits are denied, delayed, or cut off, or your injury keeps you from working, a workers’ compensation lawyer can help you understand your rights. Many attorneys handle these cases on a contingency-fee basis, meaning the fee generally comes from the recovery.
